The Law on the Protection of Whistleblowers of the Republic of Lithuania (hereinafter referred to as the Law) establishes the rights and obligations of persons who have reported violations in institutions, the grounds and forms of their legal protection, as well as measures for the protection, promotion and assistance of these persons in order to create appropriate opportunities to report violations of the law that threaten or violate the public interest, to ensure the prevention and detection of such violations.
Information about the violation at the Lithuanian Education Museum may be provided by a person who is or has been associated with the Lithuanian Education Museum by services, labor or contractual relations (consulting, contracting, subcontracting, internship, internship, volunteering, etc.) or employment or other pre-contractual relations and who provides information about the violation at the Lithuanian Education Museum.
Violation – a criminal act, an administrative misconduct, an official misconduct or a violation of labor duties, as well as a gross violation of the mandatory norms of professional ethics, an attempt to conceal the aforementioned violation or other violation of the law that threatens the public interest or violates it, is possibly prepared, committed or committed at the Lithuanian Education Museum, about which the person providing information about the violation learns from his own or should be of the service, during employment or contractual (consulting, contracting, subcontracting, internship, internship, volunteering, etc.) relationships, or during employment or other pre-contractual relations with the Lithuanian Museum of Education.
According to the Law, information on violations is provided due to:
1. a danger to public safety or health, to the life or health of a person;
2. environmental risks;
3. obstructing or unlawfully influencing investigations by law enforcement agencies or the administration of justice by courts;
4. financing of illegal activities;
5. illegal or non-transparent use of public funds or assets;
6. illegally acquired property;
7. concealment of the consequences of the violation committed, obstruction of the determination of the extent of the consequences;
8. violations specified in the list approved by the Minister of Justice of the Republic of Lithuania, prepared taking into account the scope of the European Union legal acts specified in Directive (EU) 2019/1937;
9. damage to the financial interests of the European Union as referred to in Article 325 of the Treaty on the Functioning of the European Union and further specified in the relevant European Union instruments; 10. infringements relating to the internal market as referred to in Article 26(2) of the Treaty on the Functioning of the European Union, including infringements of European Union competition and State aid rules, as well as infringements relating to the internal market resulting from actions infringing corporate tax rules or agreements aimed at obtaining a tax advantage which defeats the object or purpose of the applicable corporate tax law;
It should be noted that information on violations is provided in order to protect the public interest. The provision of information for the sole purpose of protecting personal interests shall not be considered as a communication.
A person can provide information about the violation at the Lithuanian Museum of Education in the following ways:
• at the Lithuanian Museum of Education through the internal channel (send information about the violation to the e-mail address pranesimai@lsim.lt);
• to the Prosecutor’s Office of the Republic of Lithuania directly (in accordance with the procedure established by the Description of the Procedure for submitting reports of violations in institutions to the Prosecutor’s Office of the Republic of Lithuania);
• Publicly (Public information on the violation may be provided in order to report an imminent danger to human life, public health or the environment, when urgent action is necessary to prevent such a threat and due to lack of time, it is not possible to report the violation by other means or the necessary actions were not taken in a timely manner after reporting the violation by other means.).
